1.1 This document (hereinafter also the "contract"), the internet Portal use agreement with the supplier - available by contacting info@marcheroad.com or number 3755653287 - and the privacy policy on page https://www.iubenda.com/privacy-policy/73430741, define the terms and conditions of the services provided through the portal www.marcheroad.com.
1.2 By using the services of the Marche Road internet Portal, owned by the individual company Cerpolini Alice (Tax Code CRPLCA88A44L500D; VAT number 02697940415) with registered office in Urbania (PU), Via Ponte Vecchio 5 / C, you accept the rules contained therein.
1.3 Additional terms and conditions may apply to any specific service established with the supplier.
2.1. The internet Portal, with the address www.marcheroad.com, offers a comparison between different offers in the Marche region for accommodation facilities, sports and cultural activities, food and wine experiences, excursions and typical products of the area; in particular, it allows you to make purchases and reservations between those who, operating in the context of their business or professional activity, provide activities / rooms / products (hereinafter, the "supplier" or "suppliers") and visitors to the Portal.
2.2 The Portal does not supply, own, control or own the goods and services sold; goods and services are owned, controlled and made available by suppliers. The Portal is not a party to the sales contract between supplier and customer.
2.3 The supplier who registers on the Portal is provided with:
The presence in the Portal alternatively for the following areas ACTIVITIES / ACCOMMODATION STRUCTURES / PRODUCTS;
- presence on summary maps;
- the reference to a dedicated page containing company information and customizable (the supplier's profile);
- the publication of contents, prices, images and all other information made available by the supplier within its own private page;
- direct contact with visitors to the Portal, who can purchase the goods and services offered by suppliers;
- the publication of the contents provided by visitors to the site (comments and evaluations).
3.1 Registration is a necessary condition to obtain entry on the Portal.
3.2 In order to enable the Portal, the supplier:
1) accesses the website www.marcheroad.com;
2) choose the area to register for (ACTIVITIES / RECEPTIVE STRUCTURES / PRODUCTS), by accessing the "login" section and opting for "registration";
3) check the information provided (display, insert, modify, delete).
3.3 The supplier who registers on the Portal has a User ID that coincides with the registration e-mail and a personal password, which can be replaced and recovered in case of loss.
3.4 Registration is completed at the time of enabling and, that is, with the activation of the Supplier Profile.
3.5 Once enabled, the supplier can access the Portal via a personal computer, tablet or smartphone equipped with a common web browser connected to the internet.
3.6 User ID and Password are strictly personal and non-transferable.
4.1 The provider is responsible for the content entered and represented, the data and information provided as well as all processes that are carried out with his User ID.
4.2The supplier will immediately change the User ID and Password in the event of theft, loss, loss of the Password or hacker attack of the e-mail address.
4.3 The supplier is responsible for the goods and services sold and is liable for the related complaints for lack of conformity, flaws and defects in the goods and services offered.
4.4 If there is a link on the Portal referring to the provider's site, the latter guarantees that visitors are informed about data protection.
4.5 The supplier is responsible for entering their general terms and conditions and information on data processing, collecting consent if necessary before customers make reservations and purchases with the supplier.
4.6 The provider and the visitors of the Portal do not use the services offered by the Portal for purposes other than those indicated in the articles. 1 and 2 of this contract, in particular they are aware that the use of the Portal and related services involves the following prohibitions:
- publish texts and images in violation of copyrights, trademarks or any other third party rights;
- sell counterfeit goods in violation of copyrights, trademarks or any other third party rights;
- use the Portal if you are under 18 years of age;
- publish false, false, inaccurate, misleading data;
- use customer contact information for purposes other than the conclusion of the sales contract and the obligations that follow from it for the parties;
- copy, modify, reproduce, distribute, disseminate the rights or contents of the Portal or the services offered or the intellectual property rights of the Portal without the prior and express authorization of the Portal manager or the suppliers;
- use or publish spamming, interfere with the functionality of the services offered by the Portal.
5.1 If the supplier violates these terms and conditions, Marche Road suspends and / or blocks the use of the Portal and / or cancels the supplier's profile until the violation ceases, reserving in such cases the right to compensation for the greater damage suffered. .
6.1 Unless otherwise agreed, the contract has a duration of 12 (twelve) months from enabling.
6.2 Upon expiry, the contract is tacitly renewed for a further period of 12 (twelve) months; any notice of withdrawal must be sent by registered letter with return receipt or by certified e-mail within 20 days before the deadline.
6.3 In the event of withdrawal by the supplier, Marche Road suspends the operation of the supplier's profile. After this period, Marche Road proceeds to delete all data from the Portal.
6.4 Starting from 30 (thirty) days before the deadline, notices of the deadline and any promotions provided, even individually, are sent to suppliers.
7.1 The supplier is required to pay an annual fee based on the signed Portal use agreement.
8.1 Upon notification to suppliers, these terms and conditions may be modified.
8.2 If the supplier does not accept the changes referred to in Article 8.1, he may withdraw from the contract by giving notice by registered letter with return receipt or certified e-mail by 11:59 pm on the day prior to the effective date of the changes; otherwise, these will be understood as fully and unconditionally accepted.
8.3 The occurrence of the withdrawal involves the automatic cancellation of the Supplier Profile from the Portal.
9.1 Without prejudice to the right to compensation for damage suffered, it constitutes a reason for termination of the contract pursuant to and for the purposes of art. 1456 of the Civil Code failure to comply with even one of the obligations described in art. 4 of this contract.
9.2 The operation of the resolution pursuant to art. 1456 of the Italian Civil Code it occurs by law when the Portal declares to the supplier, in writing or by certified e-mail and / or registered letter, to make use of it.
9.3 The occurrence of the termination of the contract involves the automatic cancellation of the Supplier Profile from the Portal.
10.1 The Portal is not responsible for defects and faults in the goods and services purchased through the Portal.
10.2 The Portal is not responsible for the accuracy, completeness, reliability and reliability of the content uploaded by suppliers to its page or for the comments posted by visitors to the Portal.
10.3 The Portal is not responsible for loss of earnings and damage to the image of suppliers.
10.4 The Portal is not responsible for data loss, delays, malfunction, suspension / or interruption of the Portal caused by force majeure events; interruption of electricity or telephone lines or connection to the network; natural disasters; hacking attacks; incorrect use of the Portal; malfunctions of the equipment used by the supplier.
11.INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS
11.1 All rights are reserved. In particular, all intellectual property rights (such as copyrights, patents, trademarks, service marks, commercial brands, designs, both registered and unregistered) present on the Portal and all published information content or access to which is allowed through the services provided by the Portal and in general all the information offered and contained in the Portal, are owned by Marche Road or by the suppliers who offer their products and services for sale on the Portal.

13.APPLICABLE LAW AND JURISDICTION
13.1 These terms and conditions are governed by Italian law.
